Leasehold Enfranchisement

The cost of buying the freehold or extending the lease term of a house or flat has been increasing dramatically over recent years.  We can offer advice to both Freeholders and Leaseholders about the level of Premium to be expected for different types of property and different lengths of lease.

Many houses and flats in the North East were sold on 99 year ground leases.  Any leasehold property, with an unexpired term of less than 80 years, can be subject to the rule of shared Marriage Value.  This is where the Freeholder may claim 50% of the Marriage Value between the Leasehold and Freehold interests when a lease is extended or a Freehold is acquired they are combined under the Leasehold Enfranchisement legislation.
